Abstract (ITA)
Il presente studio è volto ad esaminare le misure di solidarietà previste nel recente regolamento (UE) 2024/1351 del 14 maggio 2024. Il meccanismo che prevede una riserva di solidarietà costituito da ricollocazioni, contributi finanziari e misure alternative si presenta del tutto particolare in quanto si pone come meccanismo obbligatorio ma allo stesso tempo flessibile, nel senso che gli Stati membri possono scegliere tra le misure indicate per la quota a loro imputata, essendo misure tutte di pari valore. Lo studio cerca di evidenziare i limiti di tale meccanismo muovendo dapprima dal contenuto del principio di solidarietà applicato in materia di asilo e immigrazione e dall’altro evidenziando come nel regolamento 2024/1351 si è optato per una configurazione della solidarietà eccessivamente procedimentalizzata mettendo in discussione nel concreto la stessa effettività del principio.

This study aims to examine the solidarity measures provided for in the recent Regulation (EU) 2024/1351 of 14 May 2024. The mechanism that provides for a solidarity reserve consisting of relocations, financial contributions and alternative measures is very particular in that it is a mandatory but at the same time flexible mechanism, in the sense that the Member States can choose between the measures indicated for the share attributed to them, as they are all measures of equal value. The study seeks to highlight the limits of this mechanism by starting first from the content of the principle of solidarity applied in the field of asylum and immigration and on the other hand by highlighting how Regulation 2024/1351 has opted for an excessively procedural configuration of solidarity, questioning the very effectiveness of the principle in practice.
